A lucrative deal was recently signed between the state of Florida and the Seminole Tribe. This deal granted the tribe exclusive rights for online sports betting and casino gambling within its reservations.

The two rival gaming companies have taken the matter to court, seeking a definitive answer from the U.S. Supreme Court. They argue that the arrangement creates a potential loophole, circumventing the state’s constitutional requirement for a citizen initiative to expand casino gambling beyond tribal lands.

Describing the compact as a “backdoor” strategy, the firms assert that a Supreme Court ruling in favor of the Seminole Tribe would set a concerning precedent. This, according to the firms, would enable similar end-runs around state gaming restrictions.

Millions in Revenue at Stake

The legal dispute involves a petition against Deb Haaland, the Secretary of the U.S. Department of Interior, which oversees tribal gambling.

The stakes are high, with the Seminole Tribe already reaping over $120 million in 2024 from its online sports betting operation. State economic forecasts predict a potential total revenue share of $4.4 billion from tribal gaming through the end of the decade.

 

Dueling Lawsuits: State vs. Tribe

Simultaneously, the pari-mutuel firms have filed a case before the Florida Supreme Court against Governor Ron DeSantis and state legislative leaders who authorized the compact. The Seminole Tribe contends that the legislature has the authority to determine the initiation of online gambling. They argue that the amendment to the state constitution doesn’t take away that power.

U.S. Supreme Court: The Final Say

After losing their case before an appeals court, the rival firms filed a petition with the U.S. Supreme Court on February 8th.

Legal experts suggest that if the justices don’t intervene, Florida’s case may influence other states to allow tribes to expand their online gaming operations.
